I just knew there was some out of the mainstream views of possible future Supreme Court justice (or should I say injustice) Elena Kagan. Now I have the facts to back it up. Elena Kagan argued before the Supreme Court on September 9th, 2009 that the government could ban books since she claimed the government would not enforce it. Bad laws should be overturned even if they are rarely enforced so they will not be used to harass or imprison innocent people. There is this thing called the First Amendment that I care about since I care about the U.S. Constitution which states “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” It sounds like based off of the comments that they were discussing a piece of legislation that Congress decided to call “Campaign finance reform” to restrict the ability of the opponents of politicians who are currently in office and at the same they claimed they are against special interests or corporate interests to attempt to convince voters to reelect them. That sounds corrupt me. If that is not bad enough they could not even get the votes to amend the bill to say, the law will uphold the First Amendment. It should never be assumed government won’t abuse it’s power.
I would also like to point out to all these politicians who are so concerned with diversity that if she is confirmed that we will have a Supreme Court will consist entirely of members that went to Harvard or Yale, it will contain zero White Anglo Saxon Protestants for the first time in history. None of these justice are from towns with low populations either. If diversity is the goal why not have a justice that went to Eureka College or have a Asian or white justice considering Democrats have not appointed a white Christian since the 1960’s (or one that would uphold the U.S. Constitution)? Perhaps we could have a Supreme Court Justice from Ducktown, Tennessee (Yes that is a real place it is right next to Turtletown, Tennessee, which is also a real place) Maybe, we could have a Protestant, Buddhist or a Scientologist on the SCOTUS instead of six Catholics and three Jews. If someone really wants diversity what about ideological diversity how about we get a justice that believes space aliens built the pyramids, someone that believes the 2nd Amendment gives Americans the right to own a nuclear weapon, someone that believes the 14th Amendment’s equal protection clause gives 5 year olds just as much right to drive as anyone else (even though driving is a privilege not a right) or someone that believes yelling fire in building that is not burning are protected under freedom of speech. I disagree with all these opinions for the record. I type this to point out the diversity double standards yet again.
As if that were not outrageous enough she doesn’t follow Twilight. This can only mean one thing she must be covering up for the fact she is an evil human-blood sucking vampire. Just kidding, I am not comparing her to an evil human-blood sucking vampires because that would be rude to human-blood sucking vampires. My real concern is she received $10,000 for work she did for Goldman Sachs which is a company accused of defrauding investors. (Obama also got about $1 million in political donations from people that run Goldman Sachs but I am sure it is just a coincidence.)
Kagan also offered sympathetic ear to lesbian group Lambda’s Transgender Task Force demand to force all women to share public bathrooms and locker rooms with cross-dressing men, which is now part of Harvard’s dormitory policy. She even made up information in order to keep partial birth abortion (which is exactly what it sounds like when most of the baby is outside of the mother’s body while the baby is being killed) legal in the 1990’s. Kagan’s favorite judge is an Israeli judge named Judge Aharon Barak. Barak wrote that a judge "is subject to no authority" except himself, and he "must sometimes depart the confines of his legal system and channel into it fundamental values not yet found in it." That pretty much means the judge should do whatever he or she wants. I’m not really surprised some named Barack would do whatever he wants whether or not it is legal. Kagan even refused to answer whether our rights come from the U.S. Constitution. This is why I titled the piece “The Supreme Court likely to become even more out of touch with Americans”. I put likely in the title just in case she does not get confirmed.
Elena was asked what she would do if Congress passed a law forcing Americans to eat 3 servings of fruits and 3 servings of vegetables each day. She refused to answer the question and stated that dumb laws could be upheld which sounds like a hint she would uphold such a law or a similar law. I don’t see anything about the government forcing people to eat fruits and vegetables listed in the powers of Congress in Article I Section VIII of the United States Constitution. I say the government should not tell you what to eat or not to eat. Keep your government off my carrots and my cupcakes. I’m not if she is as bad as Sonia Sotomayor who stated "I would hope that a wise Latina woman with the richness of her experience would more often than not reach a better conclusion (as a judge) than a white male who hasn't lived that life." If the terms white and Latina were reversed the media would call it racism and there probably wouldn’t even by congressional hearings. This clearly shows Obama’s disregard for the U.S. Constitution but what do you expect from someone who spends millions of dollars to prevent the release of their original birth certificate? I will discuss this more in my next post.
